These Terms and Conditions define the rights and obligations of the Seller and the Buyer, including Consumers, arising from distance contracts, delivery of ordered Goods, complaint procedures, and other related legal relationships.
Any matters not expressly regulated by these Terms and Conditions shall be governed by the applicable laws of the Slovak Republic.
All contractual relationships between the Seller and the Buyer shall be governed by the laws of the Slovak Republic.
Where the Buyer is a Consumer, legal relationships not regulated by these Terms and Conditions shall be governed primarily by Act No. 40/1964 Coll., the Civil Code, and Act No. 108/2024 Coll. on Consumer Protection, as amended.
Where the Buyer is not a Consumer, legal relationships not regulated by these Terms and Conditions shall be governed primarily by Act No. 513/1991 Coll., the Commercial Code, as amended.

A Consumer means a natural person who, when concluding and performing a consumer contract, does not act within the scope of their business, trade, profession, or occupation.
A Business Customer (Entrepreneur) means a person who, when concluding and performing a contract, acts within the scope of their business or professional activity, in particular a person who provides a business name, Company ID, Tax ID, VAT ID, or other business identification details when placing an order.

The Buyer places an order through the Online Store based on the Seller’s offer published at https://shop.anatomic.sk by completing and submitting the electronic order form.
A valid electronic order requires all mandatory fields of the order form to be completed correctly and completely.
Before submitting the order, the Buyer is responsible for checking, in particular:
- type of Goods,
- quantity,
- selected variant,
- dimensions,
- material,
- colour,
- technical specifications,
- delivery method,
- payment method,
- total purchase price,

Orders and Conclusion of the Contract
The Buyer places an order for Goods by completing and submitting the electronic order form available in the Online Store.
Before submitting the order, the Buyer has the opportunity to review and correct all entered information, including in particular the type and quantity of Goods, selected product options, price, payment method, delivery method, delivery address, and billing details.
By submitting the order, the Buyer confirms that, prior to placing the order, they have read and understood these Terms and Conditions, the Complaints Procedure, information regarding the Consumer’s right to withdraw from the Contract, and the Privacy Policy.
The button or similar function used by Consumers to submit an order shall be clearly marked with the wording “Order with Obligation to Pay” or another equivalent wording indicating that placing the order creates an obligation to pay.
The submitted order constitutes the Buyer’s proposal to conclude a Contract.
Immediately after receiving the order, the Seller shall send the Buyer an acknowledgement of receipt of the order to the e-mail address provided in the order. This acknowledgement only confirms that the Seller has received the order and does not constitute acceptance of the order.
The Contract is concluded when the Seller sends the Buyer an order confirmation expressly accepting the order, or when the Goods are dispatched, whichever occurs first.
The Seller may include acceptance of the order in the acknowledgement of receipt, provided that such communication clearly states that the Seller accepts the Buyer’s order.
The Seller reserves the right to refuse an order, in particular in cases of:
- unavailability of the Goods,
- obvious errors in the displayed price,
- inability to manufacture or supply the ordered Goods,
- non-standard or unusual orders,
- failure by the Buyer to provide necessary cooperation.
If the Buyer has already paid all or part of the purchase price and no Contract is concluded, the Seller shall refund the received payment without undue delay.
The Seller shall provide the Consumer with confirmation of the concluded distance Contract on a durable medium, in particular by e-mail, no later than upon delivery of the Goods. Such confirmation shall contain details of the concluded Contract and any information required by applicable legislation that has not already been provided to the Consumer before the conclusion of the Contract.
Prices and Payment Terms
Prices displayed to Consumers include Value Added Tax (VAT).
The purchase price shall be increased by any applicable charges related to the selected delivery method and payment method, including in particular shipping costs and payment processing fees. The Buyer is obliged to pay such charges together with the purchase price.
Registered business partners or Buyers with individually agreed pricing conditions may, after logging into their customer account, see prices excluding VAT, discounted prices, or individually agreed prices.
The price stated in the order at the time of submission shall be binding upon the Buyer, provided that the Seller accepts the order.
The Buyer may pay for the order using the payment methods available in the Online Store, including in particular:
- bank transfer,
- cash on delivery (available within the Slovak Republic),
- any other payment method available during the checkout process.
Unless otherwise agreed by the parties, the Goods shall be delivered only after, or simultaneously with, full payment of the purchase price.
The Seller shall issue an invoice for the purchase price, which shall be sent to the Buyer by e-mail and shall also serve as a tax document.
Ownership of the Goods shall pass to the Buyer only after the purchase price has been paid in full.
The Seller reserves the right to change prices. Any changes to prices shall not affect orders that have already been confirmed by the Seller.
Where a promotional price or price reduction is displayed, such price shall remain valid until the specified date, while stocks last, or until the promotion ends.
Whenever a price reduction is announced, the Seller shall also indicate the previous price in accordance with applicable legislation.
Delivery Terms
The estimated delivery time is specified for each individual product or in the order summary before the order is submitted.
The delivery period begins on the date of order confirmation or, where advance payment has been agreed, on the date the payment is credited to the Seller’s bank account.
Delivery periods applicable to Consumers are set out in the section Special Provisions for Consumers.
Delivery periods applicable to Business Customers are set out in the section Special Provisions for Business Customers.
Goods are delivered by courier companies, logistics providers, freight carriers, or by another agreed method, depending on the size, weight, and nature of the shipment.
Available delivery methods, shipping costs, and estimated delivery times are displayed to the Consumer before submitting the order.
The Seller reserves the right to select the specific carrier based on the nature, dimensions, weight, and destination of the Goods, provided that this does not result in additional costs for the Consumer or adversely affect the agreed delivery conditions.
If the Seller is unable to deliver the Goods within the agreed delivery period, the Seller shall inform the Buyer without undue delay and propose a new delivery date or another appropriate solution.
The Consumer is not obliged to accept either the proposed new delivery date or the alternative solution.
If the parties do not agree on a new delivery date or alternative solution and the Goods are not delivered, the Seller shall refund all payments received under the Contract without undue delay and no later than 14 days from the date on which it became clear that the Goods would not be delivered.
The Seller shall not be liable for delays caused by an incorrectly provided delivery address or the Buyer’s failure to provide necessary cooperation. This shall not affect the Consumer’s statutory rights.
Upon receipt of the shipment, the Buyer is advised to inspect both the packaging and the Goods.
If the shipment is visibly damaged or incomplete, the Buyer is encouraged to notify the Seller without undue delay and, where possible, provide photographs of the damage, packaging, and shipping label.
Failure to do so shall not affect the Consumer’s statutory rights relating to defective Goods.
Complaints
The Buyer’s rights relating to defective Goods are governed by the Complaints Procedure available on the Seller’s website.
By placing an order, the Buyer confirms that they have had the opportunity to become familiar with the Complaints Procedure before concluding the Contract.
The Complaints Procedure contains detailed provisions governing the rights of Consumers.
Nothing contained in these Terms and Conditions or in the Complaints Procedure shall limit the Consumer’s statutory rights arising under the Civil Code of the Slovak Republic or applicable consumer protection legislation.

The stated amount does not include any administrative, handling, storage, or penalty charges.
The Consumer may also arrange the return shipment independently using another suitable carrier at their own expense, provided that the chosen method of transport is appropriate considering the nature of the Goods.
The Seller is not obliged to refund any payments before receiving the returned Goods or until the Consumer provides proof that the Goods have been dispatched back to the Seller, whichever occurs first.
This shall not apply where the Seller has offered to collect the Goods personally or through an authorised representative.
Unless otherwise agreed, all payments shall be refunded using the same payment method used by the Consumer for the original transaction, provided that no additional costs are incurred by the Consumer.
The Consumer shall only be liable for any reduction in the value of the Goods resulting from handling them in a manner other than what is necessary to establish their nature, characteristics, and functionality.
Exceptions to the Right of Withdrawal
The Consumer shall not have the right to withdraw from a Contract for the supply of Goods that have been manufactured according to the Consumer’s specific requirements or that have been clearly personalised.
For the purposes of these Terms and Conditions, Goods manufactured according to the Consumer’s specifications or personalised Goods include, in particular, products for which the Consumer has individually specified dimensions, shape, material, colour, technical design, personalisation, a specific combination of parameters, or any other custom requirement based on which the Goods have been manufactured or modified specifically for that Consumer.
Goods shall not be considered customised solely because the Consumer has selected one of the standard product variants offered by the Seller in the Online Store, provided that no individual manufacturing or modification has been carried out.
Where the right of withdrawal does not apply to a particular product, the Seller shall clearly inform the Consumer before the order is submitted.
Liability for Defective Goods
The Seller shall be liable to the Consumer for defects in the Goods in accordance with the Civil Code of the Slovak Republic and applicable consumer protection legislation.
The Goods shall be considered defective, in particular, where they do not comply with:
- the agreed contractual requirements;
- the general legal requirements applicable to the Goods; or
- the characteristics that the Consumer may reasonably expect, taking into account the nature of the Goods and any public statements made by the Seller or the manufacturer.
Where a defect becomes apparent within two years from the delivery of the Goods, it shall be presumed that the defect existed at the time of delivery, unless proven otherwise or unless such presumption is incompatible with the nature of the Goods or the defect.
The Consumer may notify the Seller of a defect, in particular:
- a) by e-mail sent to: anatomic@anatomic.sk
- b) by post sent to:
- Anatomic s.r.o.

- order number or proof of purchase;
- description of the defect;
- date on which the defect was discovered;
- contact details.
Where appropriate, the Consumer is also encouraged to attach photographs of the defect.
Failure to provide photographs or proof of purchase shall not prevent the Consumer from exercising their statutory rights, provided that the purchase can be proven by other means or identified by the Seller.
The Seller shall provide the Consumer with written confirmation of the defect notification without undue delay. Where the notification is made through means of distance communication, such confirmation shall be provided on a durable medium.
In the event of defective Goods, the Consumer shall, in particular, have the right to:
- repair of the Goods;
- replacement of the Goods;
- an appropriate price reduction;
- withdrawal from the Contract,
provided that the conditions established by applicable legislation are met.
The Seller shall handle and resolve the complaint within a reasonable period of time.
If the Seller rejects liability for the defect, the Seller shall provide the Consumer with written reasons for such rejection.
Nothing in this section shall affect the Consumer’s statutory rights under the Civil Code of the Slovak Republic or applicable consumer protection legislation.
The Seller shall provide the Consumer with written confirmation of the resolution of the complaint no later than 30 days from the date on which the complaint was submitted.
Alternative Dispute Resolution (ADR)
If the Consumer is not satisfied with the manner in which the Seller handled a complaint or believes that the Seller has infringed the Consumer’s rights, the Consumer has the right to request that the Seller provide a remedy.
Such request may be submitted:
- by e-mail to: anatomic@anatomic.sk; or
- by post to:
Anatomic s.r.o.
Na Stráni, Žilinská Lehota 122

If the Seller rejects the request or fails to respond within 30 days, the Consumer has the right to initiate alternative dispute resolution proceedings before a competent Alternative Dispute Resolution (ADR) body in accordance with Act No. 391/2015 Coll. on Alternative Resolution of Consumer Disputes, as amended.
The competent ADR body is, in particular, the Slovak Trade Inspection Authority (Slovenská obchodná inšpekcia) or another authorised legal entity registered in the list of ADR bodies maintained by the Ministry of Economy of the Slovak Republic.
The list of authorised ADR bodies is available on the website of the Ministry of Economy of the Slovak Republic.
The Consumer may submit a proposal for alternative dispute resolution in writing, electronically, or orally for the record before the competent ADR body.
Special Provisions for Business Customers
The provisions of this section apply exclusively to Buyers acting within the scope of their trade, business, or professional activity (“Business Customers”). They do not apply to Consumers.
A Buyer shall be considered a Business Customer if, when concluding the Contract, they act within the scope of their business or professional activity, in particular by providing a Company ID, VAT ID, or other business identification details when placing an order.
The provisions of these Terms and Conditions intended exclusively for Consumers, including but not limited to the right to withdraw from the Contract within 14 days without giving any reason, rules on alternative dispute resolution, and statutory consumer rights relating to defective Goods, shall not apply to Business Customers.
Legal relationships between the Seller and a Business Customer shall primarily be governed by the Commercial Code of the Slovak Republic (Act No. 513/1991 Coll.), unless mandatory provisions of law provide otherwise.
B2B Registration
A Buyer may apply for a B2B customer account through the Online Store.
The Seller provides the following two categories of B2B registration:

- technical product specifications;
- installation requirements;

- other commercial conditions.
Where an individual written agreement differs from these Terms and Conditions, the individual agreement shall prevail.
For the purposes of these Terms and Conditions, agreements concluded by e-mail shall also be considered written agreements.
Delivery Times – Business Customers
Delivery periods stated in these Terms and Conditions for Business Customers are estimates only, unless the Seller expressly confirms a binding delivery date in the order confirmation or in an individual quotation.
Small orders of climbing holds are generally dispatched within several business days after order confirmation or after fulfilment of any agreed conditions, including payment of any required advance payment.
For wooden climbing volumes, fiberglass climbing volumes, thermoplastic climbing volumes, or orders with a value of up to EUR 5,000 excluding VAT, the estimated delivery period is generally between 2 and 8 weeks.
Larger orders or higher production volumes may require longer delivery periods.
Following receipt of an order, the Seller shall inform the Buyer of the estimated delivery date.
A delivery date shall only become binding if expressly confirmed in the order confirmation or another written agreement between the parties.
Where delivery periods for customised products or larger projects are not stated directly in the Online Store, the Contract shall only be concluded once the Buyer accepts the proposed delivery period or the Seller confirms the order specifying the applicable delivery date.
Withdrawal by Business Customers
Business Customers may withdraw from the Contract only where such right is expressly granted by applicable law, these Terms and Conditions, or an individual written agreement concluded with the Seller.
Receipt and Inspection of Goods
The Business Customer shall inspect the Goods without undue delay after delivery.
The inspection shall include, in particular:
- quantity;
- type of Goods;
- visible defects;
- damage to packaging;
- visible transport damage.
Any visible defects, damage, or incomplete deliveries shall be reported to the Seller without undue delay.
Failure to notify the Seller of visible defects without undue delay may result in the loss of claims relating to defects that could reasonably have been identified during the inspection.
Defective Goods
The Business Customer shall notify the Seller of any defects immediately after discovering them or after they could reasonably have been identified through professional inspection.
The defect notification should include:
- identification of the Buyer;
- order number or invoice number;

- unsuitable operating conditions;
- unauthorised modifications;
- use of the Goods for purposes other than those intended.
The Business Customer is obliged to inspect the Goods immediately upon delivery and report any visible defects without undue delay.
Claims relating to visible defects submitted after such inspection period may be rejected.
Visible defects include, in particular:
- incorrect quantity;
- incorrect assortment;
- damaged or deformed packaging;
- visible damage to the Goods.
The Seller shall not be liable for:
- normal wear and tear;
- defects reported after expiry of the applicable liability period;

- force majeure events;
- dissatisfaction with the purchase price;
- defects caused by the Buyer or third parties;
- defects known to the Buyer before acceptance of the Goods where an appropriate discount was granted.
Passing of Risk
For Business Customers, the risk of loss of or damage to the Goods shall pass to the Buyer upon handover of the Goods to the first carrier, unless otherwise agreed.
Where transport is arranged by the Buyer, the risk shall pass upon handover of the Goods to the Buyer or the Buyer’s designated carrier.
Mandatory statutory provisions shall remain unaffected.
Late Payment
Where the Business Customer is in default with payment of the purchase price, an advance payment, or any other amount due, the Seller may suspend performance of current or future orders until all outstanding amounts have been paid.
The Seller shall also be entitled to statutory default interest and reimbursement of any costs incurred in recovering outstanding amounts.

To the extent permitted by applicable law, the Seller shall not be liable to a Business Customer for:
- indirect losses;
- consequential losses;
- loss of profits;
- loss of business opportunities;
- business interruption; or
- other economic losses.
The Seller’s total liability towards a Business Customer shall in all cases be limited to the purchase price of the Goods giving rise to the claim, unless mandatory provisions of law provide otherwise.
This limitation of liability shall not apply in cases of intentional misconduct or where liability cannot legally be excluded or limited.
Final Provisions
Personal Data Protection
The processing of Buyers’ personal data is governed by the separate Privacy Policy available on the Seller’s website.
Information regarding the use of cookies is provided in the separate Cookie Policy or through the cookie settings available on the Seller’s website.
Contracts are archived by the Seller from the moment of their conclusion, including after their full performance. Contracts are stored in the form in which they were concluded.
Access to archived contracts is limited to the Seller and authorised service providers, except where disclosure is required by applicable law.
Governing Law
These Terms and Conditions and all contractual relationships between the Seller and the Buyer shall be governed by the laws of the Slovak Republic.
Where the Buyer is a Consumer habitually residing in another Member State of the European Union, nothing in these Terms and Conditions shall deprive the Consumer of the protection provided by mandatory provisions of the law of the Consumer’s country of habitual residence, where such provisions apply under European Union law.
Language
Contracts are concluded in the Slovak language.
For each individual Contract, the version of these Terms and Conditions effective on the date on which the order was submitted shall apply.
Amendments
The Seller reserves the right to amend these Terms and Conditions.
Any amendments shall become effective upon publication on the Seller’s website.
Orders submitted before the effective date of amended Terms and Conditions shall continue to be governed by the version of the Terms and Conditions effective at the time the order was placed.
Severability
If any provision of these Terms and Conditions is found to be invalid, unenforceable, or ineffective, such invalidity, unenforceability, or ineffectiveness shall not affect the validity or enforceability of the remaining provisions.
The parties undertake to replace any invalid or unenforceable provision with a valid provision that most closely reflects the original commercial and legal purpose of the replaced provision.

These Terms and Conditions shall become effective on: 1.7.2026
